Welcome to DataScrap Studio (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the DataScrap Studio desktop application and related services. By accessing or using the software, you agree to comply with these Terms. If you do not agree, you may not use the application.

2. Acceptance of Terms

By purchasing, downloading, or using DataScrap Studio, you confirm that you:

Are at least 13 years old or have legal consent to use the software.
Accept all provisions of these Terms.
Acknowledge that violating these Terms may result in termination of your license.

3. License Grant

Lifetime License: Early adopters receive an exclusive, non-transferable, perpetual license to use the desktop application for personal/business use.
Annual License: Post-launch users receive a yearly subscription, renewable starting at $149/year.
Updates: All license holders receive updates during their active term. Lifetime users get all future updates at no additional cost.

4. User Obligations

You agree to:

Use DataScrap Studio lawfully and ethically.
Maintain responsibility for your API keys (e.g., BrightData) and compliance with third-party terms.
Not reverse-engineer, resell, or redistribute the software.
Ensure system requirements are met (Windows 10/11 or macOS 10.14+, 4GB RAM).

5. Payment & Refunds

One-Time Payment: Lifetime licenses require a single $149 payment.
Annual Subscriptions: Auto-renew unless canceled.
30-Day Money-Back Guarantee: Full refunds for dissatisfaction within 30 days of purchase (excludes 3rd party costs). Contact licenses@datascrap.studio.

6. Termination

We may terminate your license if you:

Violate these Terms.
Engage in fraudulent or harmful activities.
Fail to pay renewal fees (annual users).
Upon termination, you must uninstall the software and cease all use.

7. Intellectual Property

Ownership: DataScrap Studio and its code, branding, and content are owned by us.
User Data: You retain ownership of all data extracted using the software.

8. Disclaimer of Warranties

The software is provided “as is.” We do not guarantee:

Uninterrupted or error-free operation.
Accuracy of extracted data.
Compatibility with all third-party APIs or websites.

9. Limitation of Liability

We are not liable for:

Indirect, incidental, or consequential damages (e.g., lost profits).
Data loss due to user error or system failures.
Misuse of third-party APIs or extracted data.

10. Third-Party Services

BrightData: Your use of their services is governed by BrightData’s Terms.
Payment Processors: Gumroad/PayPal handle transactions; their terms apply.

11. Governing Law

These Terms are governed by the laws of INDIA, without regard to conflict-of-law principles.

12. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance. Major updates will be notified via email or in-app alerts.
